To terminate a verbal lease, the landowner must send his tenant a written notice (via Certified Mail) before September 1, notifying them that tenancy is terminated for the following crop year. In Minnesota, that assumes the lease has been starting each year at March l, since the landowner is required to give a 180 day notice or the lease automatically renews.
We’ve seen landowners wish to sell their farm and give possession, change lease terms or change operators and the verbal lease prevented them from doing so, because of this statutory requirement.
Written leases that include a termination date do not need to be terminated in written form in Minnesota and South Dakota, although Iowa requires written termination whether written or verbal.
